What this is
Aviary Radio is a catalogue of narrated audio: stories, readings, serials and shows, made in our studio and released on a schedule. You listen through our Android app. These terms are the agreement between you and us. Using the app means you accept them.
Your account
One account per household, opened by an adult. Keep the password to yourself; you are responsible for what happens under your account. The account holds up to three listeners with a membership, and one without. You may set a four-digit PIN, and once a children's profile exists a PIN is required, because it is what keeps the grown-ups' side of the house shut.
We can close an account that is used to break these terms, to abuse other people on the request board, or to copy and redistribute our audio. Where we reasonably can, we tell you first.
Membership, payment and cancelling
- A membership is bought inside the app through Google Play, and it renews by itself each month until it is cancelled. The price and the renewal date are shown by Google Play before you confirm, and they are the ones that count.
- Cancel it in Google Play, under Subscriptions, at any time. Cancelling stops the next renewal; the membership keeps working until the end of the period you have already paid for. We cannot cancel a Play subscription on your behalf from inside the app.
- Refunds are Google's to give. Their policy applies, and any statutory right to cancel you have where you live applies on top of it.
- When a membership ends, the extra listeners in the household are kept for seven days and then removed, and downloads on the device stop working. The account stays, and the free shelf stays open.
- Deleting your account asks Google Play, through RevenueCat, to cancel a running membership so that it does not renew. There is no refund for time already paid for, and if that cancellation does not go through, cancel it yourself in Google Play.
- Prices can change. We tell you before a change affects you, and you can cancel.
What you may do with the audio
A membership is a personal licence to listen: stream it, download it in the app for yourself and the listeners in your household, and play it out loud at home, in the car, in a classroom or a ward. That is it.
You may not copy the files out of the app, strip the protection from them, upload them anywhere, sell them, put them behind your own paywall, use them to train a model, or perform them publicly for money. The stories, recordings, artwork and the name remain ours. Every file we publish carries an inaudible mark that identifies it, so a leaked file can be traced back to where it came from.
Requests, messages and reports
You can ask the house for a story on the request board, vote for other people's, write to us and report a problem with a title. Keep it civil and keep other people's private business out of it. Posts are checked before they appear, and we can decline or remove one without a long explanation. Asking for something is not a promise that we will make it.
If you send us an idea and we later make something like it, that thing is still ours. We will not owe you a fee for it, and we do not accept manuscripts or finished stories.
How the voices are made
Our narrators are voices with a name and a manner. Their recordings are produced in our studio with synthetic voice technology, from scripts written and edited by people, and every title is listened to by a person before it is released. We say this here plainly, once, because you are entitled to know how the thing you are paying for is made.
Children
The service is for adults to buy and set up. Children listen through a profile inside a grown-up's account. If you set up a listener for a child, you are confirming that you are their parent or guardian and that you agree to these terms on their behalf.
What we promise, and what we do not
We will run the service with reasonable care and keep the catalogue growing. We cannot promise that it will never be unavailable, that every title will stay in the catalogue forever, or that a particular story will ever be made. Rights can lapse and titles can be withdrawn.
Nothing in these terms takes away the rights the law gives you as a consumer where you live. To the extent the law allows, we are not liable for indirect losses, and our liability is limited to what you have paid us in the twelve months before the problem.
Ending it
You can stop at any time: cancel the membership in Google Play, and delete the account in the app or at aviaryradio.com/account/delete. What deletion removes is set out in the privacy notice.
Changes to these terms
We will tell you in the app before a change that matters takes effect. If you do not want to accept it, cancel and delete the account.
